3、"Company Management Regulation of Foreign Investment Construction" has been issued by Construction Department and Foreign Trade and Economic Cooperation Department and been implemented on Dec. 1, 2002. This regulation has decided the contract scopes of foreign company, joint venture and cooperative companies as follows:
　　I. Construction Companies with foreign investment are permitted to contract the following engineering within the scope of certificate garde permission:
　　　　　① the engineering just with the foreign investment, foreign donation and foreign investment and donation;
　　　　　② the engineering with the investment of international finance organizations and passed international bidding according to the loan terms;
　　　　　③ the united construction items with the foreign capital equal or exceeding 50%, the united construction items with the foreign captial less than 50%, but relying on technological problems, Chinese construction companies cannot finished independently and with the confirmation of provicial, municipal people's governments;
　　　　　④ the construction items with Chinese investment and cannot be inplemented by Chinz construction companies independently relying on technological difficulty. The items can be contracted by Chinese and foreign companies with the confirmation of provincial and municipal people's governments.
　　II. The joint venture and cooperative construction companies should contract the engineering within the scope permitted by their certificate class.
　　They have been regualted in the section of "Supervision and Management":
　　1. For the foreign construction companies undertakeing the general contract engineering, the main structure of construction engineering should be finished by themselves.
　　2. If the foreign investment constrcutive companies cooperate with other companies, they should contract the engineering within the business cerificate scope according to the certificate class.
　　3. If the foreign construction companies disobey the first regulation of this law and contract the engineering exceeding the permitted businees scope, they will be paied the amercement of 2%-4% of the contract investment, be prohibited to shutout, decreased the certificate class, if the polt is serious, they will be revoked the certificate and the illegal income should be confiscated.

　　1、The Engineering Constract Trends in International Markets
　　International engineering contract markets have good outer environment, which has promoted the export of construction srevice and expanded market scope. Affected by the steady increasing of world economy, the world investment scope in construction industry has been expanded. According to the prediction of American standard Shaner Company, the investment scope of construction in the world will be more than USD 4,100 billion in 2003. Thus the payout of world construction will be USD 5,740 billion in 2010.
　　Being the importatnt industries of WTO service and trade, engineering and construction service have been developed rapidly. Especially relying on the implementation of WTO "Governemnt Purchase Agreement", the governmental item markets of each country have been opened more widely. At present, the actual scope of international enginering contract markets is about USD 875 billion.
　　Trends:
　　① The engineering's scope become larger with multiple modes. The operative and management capacity of contractors has been increased and the scope of service will be expanded continuously.
　　② Science & technology content is the new lever of international competition. Information technology has been widely used and the engineering management technology has been improved. The certificate requirements for engineering contractors and standard requirements for service of international service and trade will be the new technological bulwark for entering into markets.
　　③ The change of owner structure with the characteristics of increasing of private investment and decreasing of investment of government and fiannce organizations has caused the contract with capital to be the common phenomenon. Item financing will not be hold up, which can improve the requirements of owners for the quality and capacity of contractors greatly.
　　④ The annexing and reconstruction of international contractors will be more and more drastic, which can gain the new support and finance and technology.
　　⑤ The finance industry providing service for engineering construction has been developed rapidly. International Engineering Assurance Union will be formed, which can promote the development of international engineering contract industry.
　　2、Foreign construction enterprises enter into China.
　　　　　At present, Chinese construction markets' scope is about USD 200 billion per year while the foreign companies just account 2% of the market shares. Thus, Chinese Government promises that it will open the markets in 5 years. At present, there are more than 140 foreign companies joining the construction items in China in different modes and methods, direct or indirect. For Chinese companies, they occupy the markets relyingon market protection of government and low labor while for foreign companies, they occupy the markets relyingon advanced technology, construction machinery, scientific and strict management and supervision syste, as well as good after service. The remarkable shortcomings of Chinese companies will be the difficulty of their existence.
